Sustrans Raffle 2021 terms and conditions

This raffle (“Raffle”) is licenced by the Gambling Commission. Operating Licence: 000-033459-N-320804-006.  The Raffle is subject to the laws of England & Wales and run in accordance with the Gambling Act 2005.

Raffle Promoter: Sustrans, 2 Cathedral Square, College Green, Bristol, BS1 5DD.

Person responsible for Raffle: Xavier Brice of Sustrans, 2 Cathedral Square, College Green, Bristol, BS1 5DD.

All profits raised from the Raffle will go towards the work of Sustrans.

Sustrans is a registered charity (no 326550 (England and Wales) SC039263 (Scotland)) and a company limited by guarantee registered in England No. 1797726 at 2 Cathedral Square, College Green, Bristol, BS1 5DD.

1. Eligibility

   1.1       You must:-

      1.1.1       be 16 years or older;

      1.1.2       live in Great Britain; and

      1.1.3       not be an employee of Sustrans, Railway Paths Limited or any third party involved in the Raffle.

   1.2       You must not submit entries on behalf of another person including anyone under the age of 16 years old.

   1.3       We may carry out checks to confirm that all entrants are over the age of 16 years old.

   1.4       If you do not satisfy these eligibility requirements or we reasonably believe that you have breached these terms or acted fraudulently or illegally, your entry will not be included in the Raffle. Your entry fee will not be refunded and instead treated as a donation (unless you are under 16 years old where the entry fee will be refunded).

 

2. Closing date

Entries will close at midnight on 11 November 2021 and the prize draw will take place on 18 November 2021.

 

3. Entering the raffle

   3.1       All participants whose paid entries are received by midnight on 11 November 2021 will be entered into the draw.

   3.2       We cannot accept CAF vouchers or credit cards as payment for Raffle tickets. Any payments attempted to be made using a credit card will be rejected.        

   3.3        Each ticket is unique and has a serial number.  This serial number shall be used to determine the winner.

   3.4       Tickets cost £1 each.

   3.5       You may purchase up to a maximum of 60 tickets either by post, online or a combination of the two entry methods.

   3.6       If we have not received your entry by midnight on 11 November 2021, you will not be entered into the Raffle and your entry fee will be treated as a donation.

   3.7       If you are entering by post:

  • We will send your 20 tickets via post if you are a Sustrans supporter who has donated within the past two years or taken part in the Raffle in the past three years, and we are able to contact you by post. You can request more tickets by emailing supporters@sustrans.org.uk.
  • You must return postal entries to Freepost RTGY-GTEZ-BTLA, Sustrans Raffle 2021, PO Box 1127, Maidenhead, SL6 3LN by 11 November 2021.
  • You can pay for your postal tickets by completing the postal response form enclosed with the tickets, by debit card or by cheque payable to Sustrans.

   3.8       If you are entering online:

  • You can pay for your tickets via debit card. We must receive payment by 11 November 2021 for your entry to be included.

 

4. Prizes

   4.1       You can view the full list of Raffle prizes at www.sustrans.org.uk/raffle and the list is also included in the postal packs.

   4.2       We can replace any listed prize with another prize that is of equal or greater value.

   4.3       Prize winners will be picked at random in a secure environment and in the presence of an adjudicator.  Prizes will be awarded in order of selection i.e. the first ticket drawn wins first prize and so on.

      4.3.1      The Sustrans 2021 Raffle Draw will be conducted on 18 November 2021. The draw will be conducted by utilising a Random Number Generator that has been tested and approved by an independent, Gambling Commission approved, third-party test house. The results of the draw are final.

   4.4       If you have won, we will contact you by post or telephone within 7 days of the draw.   Only the individuals named on the winning tickets can collect the prizes.

   4.5       Whilst every effort will be made to contact winners, if we are unable to make contact or award a prize within 90 days of the draw, the prize will be withdrawn. If a cheque payment from us remains uncashed after 90 days of the draw, the cheque will be cancelled and the prize will be withdrawn.

   4.6      Based on the number of entries during our annual raffle in 2020, the chances of winning a ticket are 1 in 3253. Please be aware that these estimates are based on ticket sales from 2020 and may not be accurate due to the effect of Covid-19.

   4.7      Of the £42,285 received in ticket sales in our 2020 raffle, 29% went on expenses, 0% on prizes, and 71% came back to Sustrans to help fund our work.

 

5. Our responsibility to you

   5.1       We are only responsible for any loss of damage which is reasonably foreseeable and within our control. This means we are not responsible for matters including any loss as a result of lost, stolen, delayed or damaged tickets; void tickets; our inability to award your prize due to you providing incorrect or incomplete information; loss or damage caused to you by your participation in the Raffle or use of any prize.

   5.2       We will not limit or exclude in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by Sustrans, or its employees, agents or subcontractors, liability; for fraud or fraudulent misrepresentation, for breach of your legal rights in relation to our obligations.

 

6. Protection of your funds

Your entry fee to the Raffle and any prizes are not protected in the event of Sustrans becoming insolvent.

 

7. Responsible gambling and self-exclusion

   7.1       We are committed to operating the Raffle in a socially responsible way. If you or somebody you know feel that you have problems with gambling, you can seek advice and support from GamCare or from the National Gambling Helpline on 0808 8020 133.

   7.2       You can refer to our Problem Gambling Guide on the Raffleplayer website or on our Responsible Gambling page for information and help on problem gambling including how to self-exclude.

 

8. Complaints and disputes

   8.1       Our decisions on the Raffle are final.

   8.2       If you wish to raise a complaint, you can do so following our complaints policy on our Fundraising page or requested by contacting us at supporters@sustrans.org.uk.

   8.3       If we do not resolve your complaint to your satisfaction, you can ask for your complaint to be passed to the Independent Betting Adjudication Service, which can provide Alternative Dispute Resolution (ADR) to help resolve your complaint.

 

9. Data protection

   9.1       We will use your personal information for the purpose of administering the Raffle and if you are a prize winner, for promotional purposes. Please see our Privacy Statement which details how we will use your data at www.sustrans.org.uk/privacy/privacy-notice-supporters or you can request a copy by contacting supporters@sustrans.org.uk.

   9.2       For information purposes, a list of winners titles, surnames and counties will be available on our raffle page. You can also request this by contacting supporters@sustrans.org.uk.

 

10. General terms

   10.1     By entering the Raffle, you agree to be bound by these terms and conditions.

   10.2     We have the right to modify, cancel, terminate or suspend the Raffle in whole or in part.

   10.3     We may amend these terms and conditions at any time. If we make any material changes, we will notify you of these changes before they come into effect.

   10.4     These terms and conditions, including any changes, will be available at www.sustrans.org.uk/raffleTC or by request at supporters@sustrans.org.uk for the duration of the Raffle.

   10.5     These Terms and Conditions are governed by the English law and by entering the Raffle you agree to be subject to the exclusive authority of the English courts.
